Any warranty claim, to be valid, requires that the warranted material be returned to Moravek Biochemicals, Inc. within the warranty period, and in unused condition.

If any portion of the warranted material has been used or altered the warranty is voided and the invoice price of the material is due and payable.

All warranted material remains the property of Moravek Biochemicals until its invoice price has been paid in full.

Notification of any breach of warranty must be made in writing within warranty period. The warranty period is 30 days from the date of billing.

Any warranty claim, to be valid must be based on the failure of Moravek Biochemicals to have met one or more of the following warranty provisions:

1    Moravek Biochemicals, Inc. product warranty provides that all products will meet the specifications described on each product's Product Data Sheet and that authentic analytical data will be included with all products.

2    Moravek Biochemicals also warrants that radiolabeled products offered with the MORpure™ quality assurance designation will be analyzed by HPLC using radiochemical detection and that the HPLC radiochemical purity for tritium compounds will be ≥ 97% at time of delivery and that the HPLC radiochemical purity for carbon-14 compounds will be ≥ 98% at time of delivery.

3    Moravek Biochemicals also warrants that non-labeled products offered with the MORpure™ quality assurance designation will be analyzed by HPLC using UV detection and will be provided at HPLC chemical purity ≥ 98% using UV detection at the wavelength stated on the Product Data Sheet.

The maximum liability for breach of any warranty claim shall be the invoice price of the product. All statutory, express, or implied warranties including warranties as to the fitness of the product for any particular purpose or merchantability of the product are hereby expressly negated and excluded. Moravek Biochemicals, Inc. shall not be liable for special, incidental, or consequential damages of any kind.
